Terms & Conditions (AGB)

1. Scope and Contracting Party

These Terms & Conditions apply to all orders placed by consumers and businesses via our online shop greenmart.delivery.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 BGB).

2. Conclusion of Contract

2.1 The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.

2.2 By clicking the order button (“Buy now” / “Order with obligation to pay”), you place a binding order for the goods in your shopping cart.

2.3 We confirm receipt of your order immediately by automated email (order confirmation). The purchase contract is concluded when this order confirmation reaches you.

2.4 The contract language is English. The contract text is stored by us; you can view your past orders in your customer account.

3. Prices and Minimum Order Value

3.1 All prices shown are final prices and do not include shipping costs. As a small business within the meaning of § 19 UStG, we do not charge value added tax; no VAT is therefore shown. Shipping costs are displayed in the cart and at checkout before you place your order (see our Shipping Methods page).

3.2 The minimum order value is €1.00.

4. Payment

We accept the following payment methods:

• Credit/debit card and other methods via WooPayments
• Google Pay

The purchase price is due upon conclusion of the contract.

5. Delivery

5.1 We currently deliver within Germany. Delivery to other European countries is planned; we will announce the countries covered here as soon as it becomes available.

5.2 Estimated delivery time: 1–3 business days within Germany.

5.3 Shipping costs: a flat rate of 5.90 € per order within Germany. Orders with a value of 100.00 € or more are delivered free of charge.

5.4 If a product is unexpectedly unavailable, we will inform you immediately and refund any payments already made without delay.

6. Perishable Goods / Chilled and Frozen Products

6.1 Some of our products are perishable foods, including chilled and frozen items. We dispatch orders containing such items on Mondays, Tuesdays and Wednesdays only, so that no parcel is in transit over the weekend. Orders received before 12:00 on a dispatch day are sent the same day; later orders are sent on the next dispatch day. If your order also contains non-perishable items, we dispatch the whole order together on the next dispatch day. Chilled and frozen items are shipped in insulated packaging with cooling elements.

6.2 Please ensure that someone is available to receive perishable deliveries. We cannot accept responsibility for spoilage caused by a failure to accept or collect the delivery in time after a delivery attempt.

7. Right of Withdrawal (Consumers)

Consumers have a statutory right of withdrawal of 14 days. Details are set out in the Withdrawal Notice below (Section 12).

Important — exceptions: The right of withdrawal does not apply to (§ 312g(2) BGB):

• goods that spoil quickly or whose expiry date would quickly be exceeded (e.g. fresh, chilled, and frozen food);
• sealed goods that are not suitable for return for reasons of health protection or hygiene, if the seal has been removed after delivery.

8. Retention of Title

The goods remain our property until full payment has been received.

9. Warranty

Statutory warranty rights apply. For consumers, the limitation period for warranty claims on new goods is two years from delivery. For perishable goods, please note the best-before and use-by dates stated on the products.

10. Liability

10.1 We are liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body, or health, and under the German Product Liability Act.

10.2 In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfillment makes proper performance of the contract possible in the first place and on whose fulfillment you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.

11. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

12. Withdrawal Notice (Widerrufsbelehrung)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods (or of the last item, in the case of a single order delivered in multiple shipments).

To exercise your right of withdrawal, you must inform us —

— of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but this is not obligatory. To meet the withdrawal deadline, it is sufficient to send your notification before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we received your notification. We will use the same means of payment you used for the original transaction, unless expressly agreed otherwise; you will not be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

You must return the goods to us without undue delay and in any event no later than 14 days from the day on which you notified us of the withdrawal. The deadline is met if you send the goods before the 14-day period expires. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, and functioning.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods that spoil quickly or whose expiry date would quickly be exceeded, nor to sealed goods that are not suitable for return for reasons of health protection or hygiene if the seal has been removed after delivery.

13. Final Provisions

13.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence.

13.2 Should individual provisions of these Terms & Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
